- Review the Agreement of Purchase and Sale with you, so that you understand your rights and obligations in the transaction and the importance of each of them;
- Do a full title search of the property you are buying, including reviewing any surveys or Plans of Subdivision, so as to ensure that you are getting what you intended to buy and that the seller is able to convey good title to you;
- Make demands of the seller’s lawyer to repair any deficiencies in the title documents;
- Review your mortgage commitment and prepare your mortgage documents (if necessary), so that you fully understand the terms of your mortgage before you sign it;
- Arrange for the purchase of Title Insurance in your name and in the name of your lender (if any), so that the validity of your title is not just protected by our title search, but is also is underwritten by a Title Insurer such at TitlePlus or Stewart Title, protecting you and your investment against any difficulties not disclosed by the title search process;
- Review and explain all of the closing documents with you, so that you understand what each one is before you sign it;
- Report to you with copies of all closing documents, so that you have a copy for your records; and
- Electronically store a copy of your file indefinitely (for at least fifteen (15) years) just in case information is required at a later date.
If you are selling your home, we will:
- Review the Agreement of Purchase and Sale with you, so that you understand your rights and obligations in the transaction and the importance of each of them;
- Ensure that the transaction goes smoothly and with a minimum of expense;
- Receive and analyze the demands of the buyer’s lawyer regarding your title to ensure they are valid before undertaking any work on your behalf;
- If you have a title problem, we explain it to you and obtain your authority to work on it before any steps are taken. We work on it hard and quickly so that the transaction can be completed on time whenever possible, and with a minimum of added expense;
- We obtain an accurate payout statement from your lender, and pay off any mortgages from the proceeds of the sale on closing;
- Review and explain all of the closing documents with you, so that you understand what each one is before you sign it.
- Report to you with copies of all closing documents, so that you have a copy for your records; and
- Electronically store a copy of your file indefinitely (for at least fifteen (15) years) just in case information is required at a later date.
